Charges dropped against landlord Dusty Swing

McALESTER — Charges have been dropped against  a McAlester landlord who was charged earlier this year in a police impersonation case, according to court documents.

In January Dusty Swing, 46, was charged in Pittsburg County Court with one count of felony conspiracy for allegedly conspiring with three  others to kidnap his former tenants. He was arrested again in March for allegedly failing to appear in court for a preliminary hearing on the same case.
Swing said fighting the case against him has been difficult.
“I’ve had 18 different court dates and I’ve seen four different judges,” Swing said.
“I’m finally clear of all this but I’ve been fired from two jobs since this started and my wife got fired from her job,” he said.
According to court records Swing was charged along with alleged police impersonators, Brian Garrison, Gary Mooney and Margie Williford for conspiring to kidnap Veronica Osburn, Amanda Sparks and Clint Nelson.
In December Garrison, wearing a pistol, knocked on the door of Swings rental property to arrest the tenants on misdemeanor warrants, according to court records.
 Garrison allegedly told the tenants there was another man at the back door with shot gun. After Garrison allegedly showed the tenants a Task Force identification card the victims opened the door and were handcuffed and driven to jail by the Garrison, Moody and Williford. Swing followed close behind. Once at the jail,  the   tenants were released while Garrison, Moody and Williford were arrested. Swing was arrested a few days later.
“I feel what was done to the victims was wrong, but if I can’t prove my case in court then I have to agree with the judge,” said District 18 Assistant District Attorney Wes Cherry.
Pittsburg County Special District Court Judge Tim Mills dismissed the charges after a  hearing on Sept. 5 because there was no probable cause, according to the assistant district attorney.
“There wasn’t enough evidence to show he (Swing) had a conspiracy in mind,” Cherry said.
According to court records, Swing has been discharged and his bond has been exonerated.
Garrison and Mooney have pled guilty conspiracy and false imprisonment.
