McAlester man gets prison time for burglary, kidnapping

McALESTER — A McAlester man recently received a prison sentence for burglarizing a home a kidnapping someone.

Dalton Lane Garner, 19, was charged Oct. 10 in Pittsburg County District Court with one count of first degree burglary and one count of kidnapping. On Jan. 29, Garner pleaded guilty and was sentenced to serve seven years in the custody of the Oklahoma Department of Corrections.

The first count was reduced to second degree burglary, and for that charge, Garner received a seven-year sentence. He received a 15-years sentence, with the last 10 years suspended, for the kidnapping charge. Garner was fined $1,365 and his sentences are to run concurrent with two other cases against him.

According to court records, Adam Tarlton, a Kansas man, was house-sitting a Mayor Road home for his aunt and uncle, Bruce and Linda MacNeil. The MacNeil’s home is off Pyle Mountain Raid in Pittsburg County.

Tarlton told police that he had only been in town for a few days when he met Garner at a local bar, according to a police affidavit. Tarlton told police that he brought Garner back to his relative’s home on Oct. 7, the affidavit states. “They watched TV and talked,” the affidavit states, and then fell asleep. Tarlton told police that he took Garner to a local convenience store the next morning after they woke up, the affidavit states.

“On the evening of Oct. 8, Adam (Tarlton) was asleep on the couch when he heard a noise coming from the back of the residence,” the affidavit states. “...Dalton (Garner) put a black pistol to his face ... (Garner) took Adam (Tarlton) out the front door and made (him) sit in the driver rear seat of a white Ford Crown Victoria ...

“Dalton (Garner) went back into the residence and began to carry several items including guns, TV and X-Box to the car. After the car was loaded Dalton (Garner) got into the driver’s seat and drove the white car,” the affidavit states.

According to the affidavit, Tarlton was dropped off on the side of State Highway 270.

Police later showed Tarlton a photo line-up and he was able to “positively identify Dalton Garner as the individual (who) burglarized his aunt and uncle’s residence and also the individual that had held (him) at gunpoint,” the affidavit states.
