McAlester man accused of assaulting grandmother declared incompetent

McALESTER — A McAlester man who was charged with assaulting his grandmother was recently declared not competent to continue with court proceedings.

Justin Dale Roberts, 26, was charged in November in Pittsburg County District Court with one felony count of aggravated assault and battery.

On Dec. 28, after a court ordered competency evaluation was complete, Roberts was found incompetent and court proceedings were stayed. Roberts was remanded to the custody of the Oklahoma Department of Mental Health, according to court records, “for care and treatment of his mental condition.” Roberts is to remain in custody until he is declared competent by doctors, court records state.

On Nov. 13, McAlester Police officers Bobby Coggin and Loyd London responded to a domestic violence call in the 600 block of North C Street in McAlester. When they arrived, they spoke with Roberts’ grandmother, according to Coggin’s police affidavit.

According to court records, Roberts allegedly chased his grandmother through the house they shared, banged her head against the front door and choked her.

The alleged victim told police that her grandson had a fixation with knives and had threatened her with a knife the previous day, according to the affidavit. She told police that her ex-husband came to the house and confiscated the knife from Roberts.

“(She) stated Justin (Roberts) has a fixation on knives and continued going on about wanting his knives (back) ... until he worked himself up tot he point he assaulted her,” the affidavit states. “(She) said (he) grabbed hold of her in the living room ... and began choking her around the neck. (She) attempted to fight (him) off of her and made her way to the front door to escape outside. As (she) got outside the front door (he) grabbed her again and began hitting her with his fists. (She) continued to struggle to get away from (him) and he grabbed her by the head of hair, pulling two different large handfuls of hair from her head during the course of the struggle. Justin (Roberts) then began banging (her) head against the front door. (She) said she finally managed to get away from (him) and ran away to seek help.”

Police observed and photographed injuries on the body of Roberts’ grandmother, according to the affidavit, including choke and scratch marks on her neck and chest, cuts and scratches on her face and a large knot on the right side of her forehead.
