Felony

The following felony cases were decided in Pittsburg County District Court Feb. 11-17. Dispositions include dismissed cases, suspended and deferred sentences and sentences from trials and plea bargains. Listings do not include any court costs assessed.

• Lynetta Renea Keith, 45, McAlester, pleaded guilty on Feb. 12 to unlawful possession of controlled substance, marijuana, and the misdemeanor aggravated driving under the influence of alcohol, and driving with revoked/suspended license. She was sentenced to five years for unlawful possession of controlled substance, marijuana, and one year each for the misdemeanor aggravated driving under the influence of alcohol, and driving with revoked/suspended license, all suspended and to run concurrently with sentencing in another case. The charges were filed with the prior conviction enhancement for a 2003 felony drug charge.

• Mitchell Ray Stripe, 29, McAlester, pleaded guilty on Feb. 12 to possession of controlled substance, methamphetamine, and the misdemeanor driving a motor vehicle while under the influence of drugs, and unlawful possession of drug paraphernalia. He received a suspended 20 year sentence and was fined $500. The charge was filed with the prior conviction enhancement for a 2002 drug charge.

• David Lee McDonald, 39, McAlester, pleaded guilty on Feb. 17 to attempting to elude police officer, and the misdemeanor reckless driving, and transporting opened container of beer, and driving without a valid driver’s license, and failure to stop at red light. For attempting to elude police officer, he was sentenced to 20 years, with all but first 12 years suspended, and given credit for time served. The misdemeanor charges were dismissed. The charge was filed with the prior conviction enhancement for a 2004 drug charge.

• Michael Bryan McAfee, 27, McAlester, pleaded no contest on Feb. 17 to assault with a dangerous weapon. Judgment and sentencing were deferred three years.

• Tyler J. Qualls, 21, Stigler, pleaded guilty on Feb. 12 to five counts of uttering forged instrument, and the misdemeanor possession of controlled substance, marijuana, and unlawful possession of drug paraphernalia. Judgment and sentencing were deferred five years, to run concurrent.

• Tammy Lynn Peterson, 45, McAlester, pleaded no contest on Feb. 12 to burglary in the second degree. Charges were amended to breaking and entering, a misdemeanor, and judgment and sentencing were deferred one year and she was fined $100.

• Brenda Buerger, 50, Mustang, pleaded guilty on Feb. 17 to unlawful possession of controlled drug with intent to distribute, and the misdemeanor unlawful possession of drug paraphernalia. Judgment and sentencing were deferred five years. The charge was filed with a prior conviction enhancement for a 1979 drug charge.

• Sara Nicole Speigel, 27, Durant, pleaded no contest on Feb. 12 to possession of a controlled substance, the misdemeanor possession of a controlled substance, and unlawful possession of drug paraphernalia, and transporting open bottle or container of liquor and driving without a driver’s license. Judgment and sentencing were deferred five years and she was fined $500 for felony possession of a controlled substance, and $50 for driving without a driver’s license. The remaining charges were dismissed.

• Savanna Leigh Shaffer, 19, Eufaula, pleaded guilty on Feb. 12 to forgery in the second degree. The charge was reduced to the misdemeanor petty larceny. Judgment and sentencing were deferred six months.

Misdemeanor

The following misdemeanor cases were decided in Pittsburg County District Court Feb. 11-17. Dispositions include dismissed cases, suspended and deferred sentences and sentences from trials and plea bargains. Listings do not include any court costs.

• Jonathan Ryan Davis, 26, McAlester, pleaded guilty on Feb. 12 to domestic abuse – assault and battery. He was sentenced to one year, suspended, to run consecutively with sentencing in another case, and fined $100.

• Linda Sue Loyd, 53, Wister, pleaded guilty on Feb. 17 to transporting opened container of beer and was fined $100.

• William B. Pope, 36, McAlester, pleaded guilty on Feb. 12 to transporting opened container of beer and was fined $100.

• Eric David Stang, 39, Muskogee, pleaded guilty on Feb. 16 to driving without a driver’s license and was fined $50.

• Rachel Martin, 24, pleaded guilty on Feb. 12 to bringing contraband into jail and was sentenced to five days.

• Oved Morales, 32, Mesquite, Texas, pleaded guilty on Feb. 16 to driving without a driver’s license and was fined $50.

• Gerald Duane Cummins, 32, McAlester, pleaded guilty on Feb. 16 to public intoxication and was fined $100.

• Mario Dewaun Allen, 24, Okmulgee, pleaded guilty on Feb. 16 to driving with license suspended/revoked and was fined $100.

• Daniel Ruiz, 23, McAlester, pleaded guilty on Feb. 16 to public intoxication and was fined $10.

• A charge of obtaining cash or merchandise by bogus check/false pretenses against Christie L. Childress, 31, McAlester, was dismissed on Feb. 16.

• A charge of driving with license suspended against Savanna Leigh Shaffer, 19, Eufaula, was dismissed on Feb. 12.

• A charge of driving with license suspended against James Michael Kaiser, 27, Alderson, was dismissed on Feb. 12.

• A charge of obtaining cash or merchandise by bogus check/false pretenses against James A. Nelson, 40, Eufaula, was dismissed on Feb. 12.

• A charge of obtaining cash or merchandise by bogus check/false pretenses against Justin G. White, Eufaula, was dismissed on Feb. 12.

• Anthony Craig Ullrich, 26, Tulsa, pleaded guilty on Feb. 12 to driving with license suspended. Judgment and sentencing were deferred 90 days.

• Justin Wayne Adcock, 19, Quinton, pleaded guilty on Feb. 11 to possession of controlled substance and unlawful possession of drug paraphernalia. Judgment and sentencing for possession of controlled substance were deferred two years and he was fined $100. The charge of unlawful possession of drug paraphernalia was dismissed.

• Gabriel Delgado Calderon, 31, McAlester, pleaded guilty on Feb. 17 to driving a motor vehicle while under the influence of alcohol and driving without a valid driver’s license. Judgment and sentencing were deferred 11 months and he was fined $100 for each offense.
