Krebs rape suspect on the run is captured in Arizona

McALESTER — A Krebs man who is accused of raping an 11-year-old girl and who was on the run was taken into custody in Arizona and transported back to Pittsburg County.

Eufilio Hernandez Gomez, 26, of Krebs, was charged Dec. 2, 2011, with one count of felony first degree rape to a child younger than 14 years of age. Gomez is accused of having sex with an 11-year-old girl, according to court records. And the victim, according to a police affidavit, was allegedly pregnant.

Gomez was arrested in Arizona, said Pittsburg County Undersheriff Richard Bedford, because he is an illegal immigrant and because authorities there found out he had an arrest warrant in Oklahoma. He was transported to the Pittsburg County jail on Monday.

When asked by the News-Capital in December if it is true that the alleged young victim in the case was impregnated by Gomez, District 18 Assistant District Attorney Wesley Cherry answered, “That is the allegation.”

In June of 2011, Gomez was interviewed by a Department of Human Services worker, according to court records. In the interview, Gomez was asked, via a Spanish-speaking interpreter, why the young girl’s mother was in jail. Gomez said the girl’s mother was in jail for spanking her daughter, according to a police affidavit. Gomez was then asked why the mother spanked the young girl, and Gomez allegedly said it was because the young girl was pregnant.

According to the affidavit, Childress then asked Gomez who got the young girl pregnant, and Gomez allegedly pointed to himself.

Also during the interview, Gomez allegedly said that he had inappropriate sexual relations with the child “more than five times,” the affidavit states.

Gomez was later arrested on allegations of assault and battery and was picked up by ICE on June 23, according to Bedford.

Gomez was deported to Mexico by Immigration and Customs Enforcement (ICE) on July 8, according to ICE Public Affairs Officer Carl Rusnok.

Rusnok told the News-Capital that Gomez appeared before a federal immigration judge on July 5 and was subsequently deported. Rusnok also said that on Dec. 1 the Pittsburg County District Attorney’s office put forth an extradition warrant for Gomez.

In December, Cherry could not confirm that an extradition warrant for Gomez was in place. “I would have to look into his file to see if that is the case,” Cherry said. “I do know that the sheriff’s office is actively looking for him. They thought he may have already returned to the U.S.”

Gomez is currently in custody at the Pittsburg County jail in lieu of a $100,000 bond and was unavailable for comment. If convicted, he is facing a minimum of five years in the custody of the Oklahoma Department of Corrections.
