Pittsburg County District Court Dispositions

The following felony cases were decided in Pittsburg County District Court March 6 through May 13. Dispositions include dismissed cases, suspended and deferred sentences, and sentences from trials and plea bargains.

• David Harold Earls, 64, of Wister, pleaded no contest Wednesday to first degree rape and forcible sodomy of a 5-year-old girl. He was sentenced to one year, with another 19 suspended, and a charge of performing a lewd act in the presence of a minor was dismissed. Earls was also fined $1,000 and was ordered to register as Level 3 sex offender within three days of his release from prison. The charge had been filed with the prior conviction enhancement for a 1992 burglary in Pushmataha County that led to a five-year sentence, and a 1996 conviction in Hughes County for assault with a dangerous weapon that resulted in a 20-year sentence.

• Justin Michael Williamson, 25, of rural McAlester, pleaded guilty Monday to cruelty to animals and misdemeanor obstructing an officer. A three-year sentence was suspended, to be served concurrent with sentencing in a separate misdemeanor case.

• Patrick Edward Tharp, 42, of Pittsburg, pleaded guilty May 8 to possession of a controlled substance, methamphetamine, and misdemeanor possession of drug paraphernalia, driving while his license is suspended and failure to carry insurance or a security verification form. He was sentenced to the Keys of Life or an equivalent prison program, with the remainder of a 10-year prison term suspended. The sentencing was ordered served concurrent with sentencing in an Atoka County case, and he was fined $1,300. The charge was filed with the prior conviction enhancement for a 2004 conviction in Atoka County for manufacture of a controlled dangerous substance that resulted in a seven-year sentence, with five years of that time suspended.

• James Edward Brown, 52, of McAlester, pleaded guilty May 8 to larceny of merchandise from a retailer and judgment and sentencing were deferred for three years.

• Nakina Rachel Williams, 24, of McAlester, pleaded guilty May 8 to possession of a controlled substance, methamphetamine, and misdemeanor possession of drug paraphernalia, driving while her license is suspended, failure to maintain security, failure to stop at a stop sign and driving a vehicle with an improper muffler. Judgment and sentencing were deferred for two years and she was fined $330.

• Kenneth Messmer, 34, of McAlester, pleaded no contest May 8 to domestic assault and battery by strangulation and judgment and sentencing were deferred for three years. He was also ordered to complete 52 weeks of domestic abuse counseling.

• Barbara Ann Chapman, 53, of McAlester, pleaded guilty May 7 to furnishing alcoholic beverage to a person under 21. Judgment and sentencing were deferred for one year and she was ordered to complete 20 hours of community service within two months.

• A charge of obtaining cash or merchandise by bogus check or false pretenses was dismissed May 6 for Debra K. King, of McAlester.

• Joshua Vee-Guy Lane, 27, of Pittsburg, pleaded guilty Wednesday to possession of drug paraphernalia and judgment and sentencing were deferred for one year. He was also fined $100.

• Joyce Jenice Coyle, of McAlester, pleaded guilty Wednesday to obtaining cash or merchandise by bogus check or false pretenses and judgment and sentencing were deferred for one year. She was also ordered to pay $609.15 in restitution.

• Mark Allen Hacker, 39, of Quinton, of Apache Transportation, pleaded no contest Wednesday to transporting a load more than 10 feet wide on the Indian Nation Turnpike without a permit. He was fined $500.

• Loyd Marshall Fry, 65, of Indianola, pleaded guilty Tuesday to driving while his license is revoked and judgment and sentencing were deferred for 90 days. He was also fined $100.

• Jeffery Duane Falis, 28, of McAlester, pleaded guilty Tuesday to possession of a controlled dangerous substance, marijuana, and judgment and sentencing were deferred for one year.

• Anthony Raymond Furr, 22, of Kiowa, pleaded guilty Tuesday to transporting an opened container of beer and he was fined $150.

• Justin Michael Williamson, 25, of rural McAlester, pleaded guilty Monday to malicious injury to property valued at under $2,500, and petit larceny. A one-year sentence was suspended, to be served concurrent with sentencing in a separate felony case.

• Daniel Martin Paul, 20, of McAlester, pleaded guilty Monday to public intoxication and he was fined $10.

• Theresa Ann Harrison, 56, of McAlester, pleaded guilty Monday to public intoxication and she was fined $10.

• Peggy Joyce Ross, 51, of Indianola, pleaded no contest Monday to transporting an open container or bottle of liquor, and public intoxication. A six-month sentence was suspended and she was fined $110.

• Stevie Dale Sullivan, 32, of Checotah, pleaded guilty Monday to public intoxication and failure to pay taxes due the state. He was fined $20.

• Manuel T. Rivera, 21, of McAlester, pleaded guilty Monday to public intoxication and he was fined $10.

• Alixandra M. Armstrong, 19, of Hartshorne, pleaded guilty Monday to driving without a valid driver’s license. She was fined $50.

• James Ray Snowden, 48, of McAlester, pleaded guilty Monday to public intoxication and he was fined $10.

• Jason Edward Hixson, 31, of Oklahoma City, pleaded guilty Monday to driving while his license is revoked and a one-year sentence was suspended. He as also fined $200.

• Samantha Lynn York, 27, of McAlester, pleaded guilty Monday to obtaining cash or merchandise by bogus check or false pretenses and judgment and sentencing were deferred for two years. She was also ordered to pay $236.75 in restitution.

• Cody Ray Williams, 18, of McAlester, pleaded guilty Monday to possession of a controlled dangerous substance, marijuana, driving a motor vehicle while under the influence of alcohol, driving while his license is suspended, possession of drug paraphernalia, driving left of the center line and failure to wear a seat belt. Judgment and sentencing were deferred for three years and he was fined $30.

• James Bryan Shuman, 35, of McAlester, pleaded guilty May 8 to public intoxication and a 30-day sentence was suspended. He was also fined $50.

• Harold Otts, 52, reporting himself as homeless, pleaded guilty May 8 to public intoxication and he was fined $25.

• Jerry Leroy Meadows, 19, of McAlester, pleaded no contest May 8 to driving without a driver’s license and judgment and sentencing were deferred for 30 days. He was also fined $50.

• A charge of attaching more than 10 yo-yos to a line was dismissed May 8 for Lee Alton Tackett, 70, of Stuart.

• A charge of obtaining cash or merchandise by bogus check or false pretenses was dismissed May 7 for Brandy Chiles, 23, of Eufaula.

• A charge of obtaining cash or merchandise by bogus check or false pretenses was dismissed May 7 for Patty A. Trimm, 40, of Krebs.

• Elishia Marie Jim, 18, of McAlester, pleaded guilty May 6 to driving without a driver’s license and speeding in excess of the lawful maximum limit, 87 mph in 75 mph zone on the Indian Nation Turnpike. Judgment and sentencing were deferred for three months and she was fined $100.

• A charge of domestic abuse assault and battery was dismissed May 6 for Kenneth Messmer, 34, of McAlester.

• April C. Caraway, 46, of McAlester, pleaded no contest May 5 to driving while her license is suspended and judgment and sentencing were deferred for five years. She was also fined $100.

• A charge of domestic abuse assault and battery was dismissed May 5 for Kevin R. McCormick, 34, of Kiowa.

• A charge of obtaining cash or merchandise by bogus check or false pretenses was dismissed May 5 for John M. Faver, of Quinton.
