McAlester man accused of rape, soliciting minors, child porn

McALESTER — A McAlester man who has been previously accused of soliciting sex from a minor and dealing in child pornography is now being charged with rape and soliciting sexual conduct fro a minor.

Brandin Kyle Cathey, 30, was charged Dec. 11 in Pittsburg County District Court with multiple felony counts:

• Preparing, distributing and exhibiting obscene material;

• Pornography — procuring, producing, distributing and possessing juvenile pornography, and

• Soliciting sexual conduct or communication with a minor by use of technology.

He was then charged today with additional felony counts:

• Soliciting sexual conduct or communication with a minor by use of technology; and

• Two counts of first degree rape.

After Cathey was arrested and charged in the original case, a 30-year-old woman came forward and told police that Cathey had allegedly forced her to have sex with him on several different occasions, court records state.

And after seeing an article about Cathey’s charges in the McAlester News-Capital, another woman came forward and told authorities that Cathey allegedly solicited sexual conduct with minors via text messages to her cell phone, an affidavit states.

Cathey allegedly sent a text saying that he was “horny,” the affidavit states, “... asking (her) if she would find him girls from 8 to 16 years of age and at one point added that he had money. (Cathey) asked (her) how old (her) daughter is and she replied 2,” the affidavit states.

At first Cathey said “never mind that was too young,” the affidavit continues. But then Cathey allegedly asked the woman for access to her two-year-old daughter in exchange for money, the affidavit states.

In the original case, court records indicate that Cathey recently came in contact with a woman he went to school with in the past. Cathey and the woman began sending text messages back and forth and “Cathey begin texting her about meeting for sex,” a police affidavit states.

Cathey allegedly asked the woman to “find a girl for (him) to have sex with ... (and) that he didn’t care what the age was of the girls. (Cathey) texted that he would be willing to go as young as eight years of age. (Cathey) texted that he would pay more for younger girls,” the affidavit alleges.

The woman went to the police, according to the affidavit, and told them about Cathey’s alleged text messages and said his requests for “sex with young girls were on a daily basis.”

In one text message, Cathey allegedly said he had already “had sex with several young girls that were daughters of a friend of his,” the affidavit states.

The woman allowed police to retrieve data from her cell phone and on Nov. 29 police told her to go along with Cathey’s text messages, the affidavit states. Police told her that should Cathey text her inquiring about finding a young girl for sex, she should tell him that she has a friend with a 13-year-old daughter who is interested in his offer, the affidavit states.

The woman gave Cathey a cell phone number to contact, the affidavit states. McAlester Det. Capt. Gary Wansick had obtained the cell phone from the city of McAlester.

Within five to 10 minutes of the woman giving Cathey the number, police received a text message from him, the affidavit alleges.

“The conversation began as small talk but eventually turned to (the) topic of sex,” the affidavit states of the text conversation between police and Cathey. He allegedly negotiated a deal to have sex with this young girl, the affidavit states.

Cathey allegedly agreed to pay $1,000 to have sex with the young girl, the affidavit states, and offered to pay $400 more if he could have sex with her without the use of a condom.

After the deal was negotiated, the affidavit indicates Cathey then allegedly requested pictures of the young girl. Police contacted the Oklahoma State Bureau of Investigation and obtained a picture of a young female who  the OSBI had used in a previous investigation, the affidavit states.

Cathey allegedly said he was pleased with the picture but wanted one of her without her clothes on, the affidavit states.

On Dec. 3, Cathey allegedly sent a text to the police cell phone stating “that others usually send pictures to make a deal,” the affidavit states. Cathey “texted that he would send some of the pictures that he had gotten and done if it would make you feel better,” the affidavit states. The police then texted Cathey back requesting that he send the photos and Cathey sent pictures to the cell phone, the affidavit states.

“One of the pictures show a young, pre-teen female from the waist up without any clothing,” the affidavit states.

The other pictures Cathey allegedly sent include pictures of sex acts, some of which included very young girls, the affidavit states.

If convicted, Cathey is facing life imprisonment. He is currently in custody at the Pittsburg County jail in lieu of a $360,000 bond and was unavailable for comment at presstime.
