Felony
The following felony cases were decided in Pittsburg County District Court Jan. 22-29. Dispositions include dismissed cases, suspended and deferred sentences and sentences from trials and plea bargains. Listings do not include any court costs assessed.
• Jimmy L. Collins, 41, McAlester, pleaded guilty on Jan. 27 to possession of controlled substance, methamphetamine, and the misdemeanor unlawful carrying of a weapon, and driving with license suspended, and driving left of center. For possession of controlled substance, he was sentenced to 20 years, with the last 10 years suspended, and a $1000 fine. For unlawful carrying of a weapon, he was sentenced to 30 days, and a $100 fine. For driving with license suspended, he was sentenced to one year and a $100 fine, with terms to run concurrently. For driving left of center, he was fined $10. The charges were filed with prior conviction enhancements for 2004 drug charges.
• Raymond Turner Berry, 30, McAlester, pleaded guilty on Jan. 29 to driving a motor vehicle while under the influence of alcohol, and the misdemeanor driving with license revoked, and failure to carry insurance/security verification form, driving left of center. For driving a motor vehicle while under the influence of alcohol he was sentenced to five years, suspended, a $500 fine, and was ordered to attend DUI school and complete a drug and alcohol evaluation. For driving with license revoked he was sentenced to one year suspended, and a $100 fine. The charge of failure to carry insurance/security verification form was dismissed. He was fined $50 for the charge of driving left of center. The charges were filed with prior conviction enhancements for a 2004 misdemeanor charge of driving a motor vehicle while under the influence of alcohol, and a 2007 felony charge of driving a vehicle while under the influence of alcohol – aggravated.
• Toby June Little, 48, McAlester, pleaded guilty on Jan. 29 to driving a motor vehicle while under the influence of alcohol. She received a five year deferred sentence was ordered to complete a minimum 28 day in-patient treatment, attend DUI school, and fined $500. The charge was filed with a prior conviction enhancement for a 2003 charge of aggravated driving under the influence.
• Little also pleaded guilty on Jan. 29 to assault and battery with a dangerous weapon, and the misdemeanor domestic abuse – assault and battery. The charge of assault and battery with a dangerous weapon was dismissed. For domestic abuse – assault and battery she was sentenced to 18 months to run concurrent with another case. She was also fined $100.
• Jeromy Dion Zimmerman, 31, McAlester, pleaded guilty on Jan. 22 to possession of a controlled substance, alprazolam. He received a four year suspended sentence to run concurrent with another case and fined $100. The charge was filed with a prior conviction enhancement for 2009 drug charges and a charge of omitting to provide for a minor child.
• Lisa A. Evans, also known as Lisa Watkins Evans, 45, McAlester, pleaded guilty on Jan. 28 to burglary in the second degree. She received a five year suspended sentence and fined $100. The charge was filed with a prior conviction enhancement on a 2005 burglary charge.
• Matthew Cole Davenport, 28, McAlester, pleaded guilty on Jan. 22 to domestic abuse – assault and battery. He was sentenced to four years, with first year suspended, to run concurrent with another case, and fined $100. The charge was filed with a prior conviction enhancement for a 2008 domestic abuse charge.
• John Henry Boyd, 52, Muskogee, pleaded guilty on Jan. 22 to obtaining property by false pretenses. He was sentenced to 30 days.
• Zachary Levi Miller, 23, McAlester, pleaded guilty on Jan. 22 to child endangerment, the misdemeanor driving a motor vehicle while under the influence of alcohol, and driving with license suspended. For child endangerment, he was sentenced to five years and fined $100. For driving a motor vehicle while under the influence of alcohol he was sentenced to one year, suspended, to run concurrently, and fined $200. For driving license suspended he was fined $100.
• Amanda Lynn Burk, 27, Durant, pleaded guilty to grand larceny on Jan. 26. Judgment and sentencing were deferred for two years and she was fined $100.
• Jeremiah Daniel Cline, 22, Oklahoma Department Of Corrections, pleaded guilty on Jan. 29 to possession of marijuana by an inmate. He was sentenced to two years, to run consecutive to current sentence, and fined $200.
• Christopher Stanfield, 40, Quinton, pleaded guilty on Jan. 29 to driving a motor vehicle while under the influence of alcohol. Judgment and sentencing were deferred five years and he was fined $500. The charge was filed under prior conviction enhancement of a 2000 charge of driving a motor vehicle while under the influence.
• Thomas D. Mills, 21, McAlester, pleaded guilty on Jan. 29 to grand larceny. Judgment and sentencing were deferred five years and he was fined $1,000.
• Judy Freeman, 32, McAlester, pleaded no contest on Jan. 22 to possession of controlled substance, cocaine, and the misdemeanor public intoxication. Judgment and sentencing were deferred five years for possession of controlled substance, and for 30 days for public intoxication.
• Justin Tyme Crosby, 23, McAlester, pleaded guilty on Jan. 22 to possession of controlled substance, methamphetamine and marijuana, and the misdemeanor driving a motor vehicle while under the influence of alcohol, and driving with license revoked, and public intoxication. Judgment and sentencing were deferred five years. The charges were filed under prior conviction enhancement for 2008 drug charges.
• Joseph Allen Higgins, 22, Quinton, pleaded guilty on Jan. 22 to possession of controlled substance, methamphetamine and marijuana, and the misdemeanor public intoxication. Judgment and sentencing were deferred five years.
• Charles Ray Edwards, 47, McAlester, pleaded guilty on Jan. 29 to possession of controlled substance, methamphetamine, and the misdemeanor possession of controlled substance, marijuana, and unlawful possession of drug paraphernalia. Judgment and sentencing were deferred five years.
Misdemeanor
The following misdemeanor cases were decided in Pittsburg County District Court Jan. 22-29. Dispositions include dismissed cases, suspended and deferred sentences and sentences from trials and plea bargains. Listings do not include any court costs.
• Matthew Cole Davenport, 28, McAlester, pleaded guilty on Jan. 22 defrauding an innkeeper. He was fined $50.
• Joseph Allen Higgins, 22, Quinton, pleaded guilty on Jan. 22 to driving with license suspended and failure to display headlights when required and was fined $100 for each offense.
• Phillip Charles Russell, 50, McAlester, pleaded guilty on Jan. 28 to obtaining cash or merchandise by bogus check/false pretenses. He was sentenced to one year to run concurrent with another case and ordered to pay restitution.
• Misty Dawn Payne, 32, Hartshorne, pleaded guilty on Jan. 26 to driving without a driver’s license and was fined $50.
• Joseph Scott Storie, 38, Tulsa, pleaded guilty on Jan. 25 to driving with license revoked. Judgment and sentencing were deferred 90 days and he was fined $100.
• Jacob Dean Miller, 22, McAlester, pleaded no contest on Jan. 22 to transporting opened container of beer. Judgment and sentencing were deferred six months and he was fined $100.
• Jennifer Joann Chambers, 37, Eufaula, pleaded guilty on Jan. 25 to driving with license suspended. Judgment and sentencing were deferred 90 days and she was fined $100.
• Jack Steven Lamont, 32, Crowder, pleaded guilty on Jan. 29 to driving with license suspended. Judgment and sentencing were deferred 90 days and he was fined $100.
• Danny Osborne, 54, Wilburton, pleaded guilty on Jan. 29 to possession of controlled substance, marijuana, and driving a motor vehicle while under the influence of drugs, and unlawful possession of drug paraphernalia, and speeding in a posted zone. The charge of possession of controlled substance, marijuana, was dismissed. Judgment and sentencing were deferred three years each for driving a motor vehicle while under the influence of drugs, and unlawful possession of drug paraphernalia, and for 30 days for speeding in a posted zone.
• Matthew Montgomery, 18, McAlester, pleaded guilty on Jan. 22 to resisting an officer. Judgment and sentencing were deferred three years and he was fined $100.
• Jorge Lariuz Muñoz, 40, Perkins, pleaded no contest on Jan. 25 to resisting an officer and public intoxication. Judgment and sentencing were deferred for 30 days for both offenses.
• Cody Dale King, 20, Hartshorne, pleaded guilty on Jan. 25 to driving with license suspended. Judgment and sentencing were deferred six months and he was fined $100.

Two killed in holiday weekend collisions on U.S. 69, Lake Eufaula
Oklahoma Highway Patrol reported two accidents with fatalities in the area, despite warnings last week to use extra caution on the road and in the water this Labor Day weekend. One man died as a result of a collision between two boats on Lake Eufaula Saturday evening, and another person died in an automobile accident on US Highway 69 near Canadian Sunday night.

Cold case team to investigate Okla. woman’s death
“I got a phone call at 9 o’clock in the morning on Feb. 1 and was told that my house had burned, everything I owned was gone, my wife was dead and both my dogs were dead,” he said. “I literally had nothing left but the suitcases I had with me.”
