Ex Convict files claim against County

McALESTER —  Pittsburg County Commissioners were notified of a tort claim by former Pittsburg County jail inmate against the county during Monday’s regular meeting in the conference room of the Pittsburg County Courthouse.

According to court records former inmate James Christopher Payne, convicted of one count of felony stalking in 2010,  has filed the claim against the Pittsburg County Commissioners, Pittsburg County Sheriffs Department, Sheriff Joel Kerns, Jail Administrator Missy Eldridge, and the Oklahoma Department of Corrections. 

 Payne was incarcerated in 2010 for one county of felony stalking for posting a picture of a plaster cast of a woman’s face with a knife through it on MySpace and stating repeatedly that he is going to kill her. He also allegedly repeatedly stalked the woman between Dec. 8 2009 and Jan. 12, 2010, according to court documents.

According to the tort claim from attorney Derek Ingle of Corley and Assoc. in Tulsa, Payne states he was allegedly incarcerated at the Pittsburg County Jail for three months beyond his release date. The claim states Payne is seeking an award of money damages to the maximum allowable.
