McALESTER —
A Hartshorne man was dismissed Monday of six counts of rape by force or fear.
Michael Allen Smallwood, 22, had been accused of raping a 16-year-old girl multiple times. On March 9, he was officially charged in Pittsburg County District Court with six counts of first degree rape by force or fear.
According to court records, the 16-year-old girl informed police that she was seeing Smallwood for approximately one week and on each night during that time period, she would sneak out of her home at 2:45 a.m. to meet Smallwood.
District 18 Assistant District Attorney Wesley Cherry said that the decision was made to dismiss the case by his office because the alleged victim was too traumatized to testify. “It was a tough decision to make,” Cherry said.
