A McAlester teenager is being charged as an adult in Pittsburg County District Court. On Jan. 5, Gabe Hunter Lusk, 15, was charged with attempted robbery by force or fear under the Youthful Offender Act, according to court records.
Lusk is accused of using a gun and attempting to rob a group of minors.
According to court records, Lusk had his initial court appearance on Jan. 5 and was released on his own recognizance. He was also ordered to wear an ankle monitor, court records indicate.
According to District 18 Assistant District Attorney Wesley Cherry, Lusk is being charged as an adult because his alleged crime is a violent crime. “Legislature has different vehicles for sub classes of defendants,” Cherry said. Lusk is a juvenile offender being charged as an adult under the “Youthful Offender Act.”
“He is being charged as an adult, but the process will be somewhat different. For example, the form of information is different,” Cherry said. Lusk is being charged this way because his crime falls under a “certain subset of crimes, specifically, violent crimes,” Cherry said.
If convicted, Lusk faces imprisonment of not less than five years, according to court records. As of presstime today, the News-Capital could not find contact information for Lusk or his parents for comment.
