Council reviews branding, planning contract changes

McALESTER — McAlester city councilors have reviewed a revised version of a contract with Marketing Alliance, of Jackson, Miss. — with the caveat that they don’t want any possible legal disputes confined to Mississippi.

Now, it’s up to Marketing Alliance to approve the contractual changes made by the city.

City councilors went over the proposed contract when they met in regular session Tuesday night in the Council Chambers at City Hall. The agenda item called for a “final review” of the Marketing Alliance agreement, with changes and comments from the city attorney.

The price tag of the agreement remains the same. At a cost of $18,500, Marketing Alliance is supposed to come up with a marketing plan for the city, as well as a new logo.

Ervin advised the council to change a clause in the contract, as presented to the city by Marketing Alliance, that called for any legal arbitration that might result between the two parties to take place in Mississippi.

The city attorney suggested that the matter about arbitration be stricken in its entirety.

“We have stricken the venue language,” Ervin said, adding that the city is asking for Oklahoma applicable law be in place for the contract.

In case of a contractual disagreement or dispute later, on “We don’t want our only recourse to be in  Mississippi,” Ervin said.
